{"id":2030,"date":"2025-05-03T16:36:10","date_gmt":"2025-05-03T16:36:10","guid":{"rendered":"https:\/\/suhunews.id\/?p=2030"},"modified":"2025-05-03T16:36:10","modified_gmt":"2025-05-03T16:36:10","slug":"kasus-pencabulan-difabel-ganda-oleh-kakek-di-barru-masuki-tahap-penentuan","status":"publish","type":"post","link":"https:\/\/suhunews.id\/index.php\/2025\/05\/03\/kasus-pencabulan-difabel-ganda-oleh-kakek-di-barru-masuki-tahap-penentuan\/","title":{"rendered":"Kasus Pencabulan Difabel Ganda oleh Kakek di Barru Masuki Tahap Penentuan"},"content":{"rendered":"<p><strong>Suhunews.id<\/strong>&#8211; Kasus kakek peot cabuli difabel ganda di Barru, Sulawesi Selatan, akan masuk agenda penuntutan di Pengadilan Negeri Barru pada Selasa pekan depan.<\/p>\n<p>Terdakwa AM (71) kini ditahan di Rutan Kejaksaan Negeri Barru.<\/p>\n<p>Dia dilaporkan karena mencabuli perempuan penyandang disabilitas ganda pada Januari 2024 lalu.<\/p>\n<p>Kasus ini mengundang perhatian dan keprihatinan banyak pihak.<\/p>\n<p>Pengacara senior Kota Makassar, Firman SH, menyebut perbuatan AM mencerminkan rendahnya perlindungan hukum terhadap penyandang disabilitas, khususnya perempuan.<\/p>\n<p>\u201cPeristiwa ini tidak hanya mencoreng moral pelaku, tetapi menjadi cermin bagaimana perempuan dengan disabilitas masih sangat rentan terhadap tindak kejahatan seksual,\u201d ujarnya kepada wartawan, Sabtu (3\/5\/2025).<\/p>\n<p>Awalnya niat potong rambut, berakhir di kamar lantai satu salon<\/p>\n<p>Dalam BAP penyidikan, terungkap bahwa AM datang ke salon tempat korban berada dengan alasan untuk memotong rambut.<\/p>\n<p>Namun, setelah ajakan berhubungan badan ditolak oleh pegawai salon, AM justru turun ke kamar lantai satu dan mencabuli korban, yang saat itu sedang tertidur.<\/p>\n<p>Korban adalah perempuan penyandang disabilitas ganda\u2014fisik dan intelektual.<\/p>\n<p>Tindakan keji AM dipergoki langsung oleh pegawai salon dan ibu korban, yang curiga setelah mendengar suara gaduh di kamar tersebut.<\/p>\n<p>Tawarkan uang Rp700 ribu agar kasus tidak dilanjut<\/p>\n<p>Setelah dipergoki, AM mencoba meredam kasus dengan memberikan uang sebesar Rp700 ribu.<\/p>\n<p>Uang tersebut disebut sebagai bentuk \u201cuang tutup mulut\u201d agar kasus tidak dilanjutkan ke jalur hukum. Namun keluarga korban menolak dan memilih melaporkan AM ke polisi.<\/p>\n<p>Kasus ini bisa dijerat KUHP dan UU TPKS<\/p>\n<p>Firman SH bersama koleganya, Aswandi Hijrah SH.MH dari Lembaga Hukum Keadilan Nusantara, menilai bahwa perbuatan terdakwa dapat dijerat dengan pasal-pasal di KUHP dan UU Tindak Pidana Kekerasan Seksual (TPKS).<\/p>\n<p>\u201cKUHP jelas mengatur larangan dan ancaman pidana bagi pelaku pencabulan. Pasal 289 dan 290 KUHP dapat digunakan dalam kasus ini karena ada unsur kekerasan atau ancaman kekerasan terhadap korban, serta korban berada dalam keadaan tidak berdaya,\u201d ujar Aswandi.<\/p>\n<p>\u201cUU TPKS sangat tegas dalam memberikan perlindungan terhadap korban disabilitas. Pasal 42 hingga 47 mengatur secara khusus bentuk perlindungan, termasuk kewajiban negara untuk memastikan keadilan dan perlakuan setara terhadap korban dengan kebutuhan khusus,\u201d tambah Firman.<\/p>\n<p>Publik desak hukuman maksimal untuk kakek peot<\/p>\n<p>Warga Barru, khususnya di sekitar Pasar Pekkae, mendesak agar terdakwa AM dijatuhi hukuman maksimal.<\/p>\n<p>Mereka menilai perbuatan AM tidak bisa ditoleransi, terlebih dilakukan terhadap korban yang memiliki keterbatasan.<\/p>\n<p>\u201cKalau cuma dihukum ringan, tidak akan ada efek jera. Ini perbuatan yang biadab,\u201d ujar seorang warga yang enggan disebut namanya.<\/p>\n<p>Korban belum memiliki kuasa hukum pribadi<\/p>\n<p>Sidang kasus ini telah digelar sebanyak enam kali.
